In addition to the jurisdiction of the
Board to hear the disputes discussed above,
California Law imposes additional obligations
and restrictions on the actions of the factories
as they affect new motor vehicle dealers.
These provisions make it unlawful for a
manufacturer or distributor to unreasonably
withhold consent to a proposed buy-sell
transaction, to refuse to deliver vehicles
in reasonably quantities to individual dealers
(ie. allocation disputes), or to compete
with dealers, subject to a number of specific
terms and conditions contained in the Code,
(factory ownership disputes). Claims made
by the dealers under these Vehicle Code
sections are traditionally filed in the
Superior Court in the county in which the
dealership is located.
